We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

We don’t share any personally identifying information publicly or with third-parties, except when required to by law.

AGREEMENT

By browsing the Website, or placing an Order, you unconditionally and irrevocably agree to these Terms and Conditions as set out below.
These Terms and Conditions apply to you, the Website user and your usage of the RadAsEff Website and associated social media platform, software, networks and processes, including the purchase of goods or services through the Website.

DEFINITIONS

In this Agreement:

Agreement means the terms and conditions contained in this document, including any relevant terms of any order placed by you the User through the Website (if applicable).

Customer means the person named on a RadAsEff.com invoice or sales document.

Goods means the fitness challenge, memberships, classes, tutorials and/or products listed in an Order.

Intellectual Property includes any and all intellectual and industrial property rights throughout the world, whether subsisting now or in the future, including rights of any kind in:

(a) inventions, discoveries and novel designs, whether or not registered or registrable as patents, innovation patents or designs, including developments or improvements of equipment, technology, processes, methods or techniques;

(b) literary works, dramatic works, musical works, artistic works, cinematograph films, television broadcasts, sound broadcasts, published editions of works and any other subject matter in which copyright (including future copyright and rights in the nature of or analogous to copyright) may, or may upon creation of the subject matter, subsist anywhere in the world;

(c) registered and unregistered trade marks and service marks, including goodwill in the business concerned in the relevant goods and/or services;

(d) trade, business or company names; and

(e) internet domain names, whether created or in existence before or after the Execution Date and includes any thing, whether tangible or intangible, which incorporates, embodies or is based on any of the things referred to in clauses (a) to (f) inclusive of this definition.

RadAsEff.com also referred to as “The Website”, means the business operated by The Raddest LLC., a limited liability corporation registered in Minnesota.

Material means any information (including but not limited to data, source codes, and drawings) or images in any form (whether visible or not) stored on or in use with the Website.

Pre-sale means Products that are sold in anticipation of being in stock on or near to the dispatch date stated in the Product listing on the Website.

In this Agreement:

(f) a reference to $ is to the lawful currency of the United States of America;

(g) a reference to a statute includes its delegated legislation and a reference to a Statute or delegated legislation or a provision of either includes consolidations, amendments, re-enactments and replacements;

(h) a word importing the singular includes the plural (and vice versa), and a word indicating a gender includes every other gender;

(i) if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;

(j) where the day on or by which any sum is payable or any act, matter or thing is to be done is a day other than a Business Day, that sum must be paid and that act, matter or thing must be done on the immediately succeeding Business Day; and

(k) includes in any form is not a word of limitation.

SITE USE

The Website may contain links to other web sites. Such links are provided for convenience only and may not remain current or be maintained. The Raddest LLC is not responsible for the content or privacy practices associated with linked web sites.
You must ensure that your access to, or use of the Website is not illegal or prohibited by laws which apply to you.
You must take your own precautions to ensure that your process for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system. The Raddest LLC takes no responsibility for any such damage which may arise in connection with your use of the Website.

PRICING

All prices quoted on the Website are in United States dollars unless otherwise specified.
All prices displayed on the Website are subject to change without notice. Prices for items in an Order are fixed once your Order has been confirmed. Subsequent price changes either up or down will not be retroactively applied to confirmed Orders.
You agree to pay any additional duties and taxes that your country or state may wish to impose on your order based on the imputed or actual value of the Goods.

ORDERS

You may place an Order by following the instructions on the Website. Your Order will be submitted by completing payment details and clicking the ‘confirm’ button.
Orders will be deemed to have been received by the Website and our team at the time RadAsEff.com sends an Order confirmation to your nominated e-mail address.
Abbey & The Raddest LLC. will primarily communicate with customers via e-mail. It is the customer’s responsibility to ensure the correct contact details are entered and that the nominated e-mail address is regularly checked for correspondence.
Each Order (once confirmed) represents a separate agreement between The Raddest LLC and you.
In the event of a cancelled Order, funds paid in relation to that Order will be refunded in full as soon as is reasonably practicable. You will be provided with e-mail acknowledgement (or direct message when necessary) of the cancellation and refund.
The Raddest LLC accepts no responsibility for Orders that are declined or not accepted due to disruptions with internet connections.

PAYMENT

You may provide your nominated credit card during the purchase process described on the Website. • Payment on the Website may be made via a valid Credit Card.
Payment for Orders will be processed immediately upon confirmation of your Order.
If you’re nominated payment method triggers The Raddest LLC internal suspicious transaction protocols, we may contact you to confirm additional details, or rescind the transaction.

REFUNDS & CANCELLATIONS

The customer must comply with directions from RadAsEff team to facilitate a return.
You acknowledge and agree that the RadAsEff team will not refund your Order based on a change of mind.

INTELLECTUAL PROPERTY

All Intellectual Property in any Material on the Website is the property of The Raddest LLC.
Unless expressly authorized under these Terms and Conditions or otherwise, you may not reproduce adapt, modify, display, perform or distribute any Material or any part of any Material.

1. Permission is granted to temporarily download one copy of any downloadable materials on the Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial); 3. attempt to decompile or reverse engineer any software contained on the School’s web site; 4. remove any copyright or other proprietary notations from the materials; or

MUSIC USE

The Raddest LLC does not own the rights to any of the music used in the background of online classes. • The Raddest LLC does not own the rights to the music used in choreography tutorials.
This music was however purchased legally. If you believe your content copyright has been infringed upon please contact me with your information and issue.

Challenges & Classes via Live Stream & Virtual Zoom Conditions

* Challenges & online classes are available solely for the use of the customer who completed the checkout process. * It is not permitted to attend virtual classes in large groups unless those in the group have purchased the class or challenge. * It is your responsibility to ensure that you feel sufficiently warmed up throughout each class before attempting any stretches, tricks, or high intensity exercises. If you do not feel fully warmed up, take some extra time to continue your warm up.

* If you are injured you must notify us before each class. You must take extra care when taking part in the live-stream classes and don’t push yourself further than your limit. You must also obtain permission from your doctor prior to starting the stretching classes to ensure that it is safe for you to participate.

* If an exercise feels too advanced for you, please choose the modification, ask for one or sit it out and resume on the next exercise that you feel more comfortable with.

* If a stretch feels too advanced for you, sit it out and resume on the next stretch that you feel more comfortable with. * If a pole or floor trick feels too advanced for you, please choose the modification, ask for one, or sit it out and resume on the next trick that you feel more comfortable with.

* Abbey or The Raddest LLC is not responsible for any injury or damage caused during and after each stretching class. This includes, but is not limited to, injuries as result of insufficient warm-up, incorrect performance of exercise stretches or tricks.

If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such exercise activities. These risks may also exist for those who are currently in good health right now.
Abbey is not a medical doctor. Her advice whether it be on the Website, in her custom training programs, during live-streams, Zoom classes, tutorials & courses is intended as a substitute for medical advice. TERMINATION/CANCELLATION

The Raddest LLC may terminate your membership, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Services or the Site (or any portion, aspect or feature of the Services or the Site) for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that you are under 14, or under 18 and not supervised by a parent or legal guardian. Any such termination will result in the full refund for lifetime membership; all recurring charges will be cancelled.
You may terminate your Membership at any time, for any reason, by following the instructions on the User’s Account page.
As a subscriber, you may cancel your membership at any time. Cancellations received after the stated deadline will not be eligible for a refund. All refund requests must be made by the member or credit card holder.
To cancel your account, email hiabbey@radaseff.com at least 7 days prior to your next billing date with the name of the member and/or transaction number. Once your cancellation is effective you will no longer have access to our large selection of premium lessons.
Even after Membership is terminated, this Agreement will remain in effect.
